Former Tennessee Teacher Accused of Kidnapping Student Indicted on Two Federal Charges

Additionally, Cummins is indicted on a charge of destructing, altering or falsifying records in federal investigations, which carries a sentence up to 20 years imprisonment, records show.

According to the U.S. Attorney's Office in Nashville, 50 Year old Tad Cummins was charged with obstruction of justice and transporting a minor across state lines for the objective of engaging in criminal sexual conduct.

Tad Cummins has been indicted on two counts today after a federal grand jury returned their verdict.

He was also charged with destruction, adjustment or falsification of records in a federal investigation, which has a maximum sentence of 20 years.

Cummins, 50, was arrested for kidnapping after he disappeared with a 15-year-old Tennessee student on March 13.

He had been suspended in February from the local high school after a student reported seeing him and the teenage girl kissing in a classroom, authorities said. Authorities credit the caretaker of a remote northern California property for helping police find her.

Cummins also faces state charges of aggravated kidnapping and sexual contact with a minor.

The pair were discovered 38 days later in a remote cabin in northern California near the OR border, where he was arrested and she was taken into protective custody.

Cummins' attorney didn't immediately respond to an email seeking comment.

Shabazz also said his client was not a flight risk, although a federal magistrate in Nashville denied Cummins's request for pretrial release last week.

Cummins' California attorney has noted that he has no prior criminal history and argued that he did not coerce, force or threaten Elizabeth - which her family disputes.
