  • Bill Cosby walks from the Montgomery County Courthouse during his sexual assault trial in Norristown Pa. Friday

Having failed to reach a decision, the men and women of the jury retired for the night and will reconvene this morning.

Cosby is charged sexually assaulting Constand, 44.

Cosby's spokesman, Andrew Wyatt, read the statement from longtime Temple University official Marguerite Jackson, who said Constand told her of a plan to falsely accuse a "high-profile person" of sexual assault so she could sue and get money.

McMonagle also questioned why Constand would continue spending time privately with Cosby even after he made sexual advances that she said she rebuffed.

McMonagle said that while the comedian had been unfaithful to his wife, he did not commit a crime.

The disgraced comedian is fighting three charges of aggravated indecent assault, amid allegations he drugged and attacked Andrea Constand, a former employee at his alma mater, Temple University, during a 2004 encounter at his Pennsylvania home.

"Drugging somebody and putting them in a position where you can do what you want with them is not romantic", he added.

"Ladies and gentlemen, he has told you what he has done", District Attorney Kevin Steele said in his closing argument, according to Reuters.

The prosecution had rested its case on Friday after calling 12 witnesses.

Her lawsuit against him had elicited four days of testimony from Cosby about his sexual conduct with some of them.

Cosby, who has been accused of decades-old sexual misconduct by more than 50 women in recent years, faces a lengthy jail stint if convicted.

The jury was to decide whether Cosby was guilty of three counts of aggravated indecent assault, each of which carried a possible 10-year prison sentence.

The black comedian once known as America's Dad for his portrayal of kindly Dr. Cliff Huxtable on "The Cosby Show" suggested recently that race could have played a role in the case against him. He also pointed out that Constand spoke by phone with Cosby numerous times after the alleged assault. He talks in the deposition of "the penile entrance" and "digital penetration", and he told Constand's mother, when she called to confront him, that her daughter had had an orgasm.

"Don't leave your common sense in Pittsburgh."This isn't talking to a trustee".

The megastar turned pariah declined to testify and the defense called just one witness, a police detective, before resting their case in just minutes on the sixth day of what was initially billed as a two-week trial.

Instead, most of Monday was given over to closing arguments, first the defense and then the prosecution, followed by jury instructions from Judge Steven O'Neill.

During the defense closing argument, Camille Cosby and Constand sat in front rows in the courtroom, only feet apart. They said that Constand's initial statements to police were full of inconsistencies that undermine the truthfulness of her story. "They'll take the edge off", Cosby told her, she testified. His deposition was sealed for years until a judge released parts in 2015 at the request of The Associated Press, prompting a new set of prosecutors to take a fresh look at the case.

The fate of famed entertainer Bill Cosby is in the hands of the jury on charges that he sexually assaulted a woman in his Cheltenham home. "This is not a civil case about money, money, money". "We're talking about all the man's tomorrows".

The defense could call other witnesses to try to bolster their argument that Cosby had a consensual relationship with Constand, 35 years his junior.

"All of the fancy lawyering ...can't get you around (Cosby's) own words", the prosecutor said. "He says she doesn't say 'yes, '" Steele said.

"There are some things in this case that should be fuzzy. Why?"

Last week, accuser Andrea Constand testified that Cosby drugged and molested her in 2004 at his gated estate near Philadelphia. "She spent a lot more time trying to forget what happened than trying to remember that night". Constand testified the pills left her disoriented and unable to resist him. Prosecutors have suggested he drugged her with something stronger — perhaps quaaludes.

The defense offered its closing argument after presenting a single witness: a detective who reminded jurors that police wondered why Constand had visited with Cosby at a casino.

Cosby's legal team, led by McMonagle and Angela Agrusa, never confirmed that he would testify, and legal experts say it's usually not a wise move because it opens up a defendant to potentially damaging cross-examination.
