Later in the day, he called on the judge to declare a mistrial. Testifying for more than seven hours last week, Constand denied there was any romance between them and told jurors she had rebuffed his advances before the assault.
The trial outside Philadelphia involves Cosby's sexual encounter with a woman at his home in 2004.
Ms Constand and her mother were in court for the announcement from the jurors. He says he gave her an over-over-the-counter cold and allergy medicine to help her relax and that the encounter was consensual.
"My gut feeling is that they have at least one or two jurors hung", said Cohen, who past year represented former-Donald Trump campaign manager Corey Lewandowski in a battery case. The judge told them to try again for a verdict.
