What Winning A Supreme Court Case Really Feels Like

  • Supreme Court Not Budging Refuses to Hear Case on Carrying Guns in Public

The justices ruled in favor of lesbian couples by throwing out a December ruling by the Arkansas Supreme Court decision that upheld state officials' refusal to name the wives of the birth mothers as parents on birth certificates.

The high-profile case originated in 2012, when David Mullins and Charlie Craig stopped in to Masterpiece Cakeshop in Denver to ask about a cake for their wedding reception.

Is it more important to protect a business owner's religious beliefs or to protect the idea that any customers who show up should be treated equally - regardless of their sexual orientation?

Finally, in Pavan v. Smith the court held that "the Constitution entitles same-sex couples to civil marriage on the same terms and conditions as opposite-sex couples".

But Craig and Mullins say they're hopeful, "We strongly believe in the institution of the Supreme Court and we believe that they will treat this case with the same gravity that they treat all the cases". The couple filed a complaint with the Colorado Civil Rights Division, which found that Phillips had violated the Colorado Anti-Discrimination Act.

"I will continue to review today's decision to determine the appropriate next steps upon remand to the Arkansas Supreme Court to ensure that the law is followed properly", she said.

But Colorado courts ruled that the state's public accommodation law, which bans discrimination by companies offering their services to the public, did not allow Phillips to refuse the gay couple's request.

Montgomery caused a stir in 2015 when he refused to have his staffers provide the same legal help to couples seeking to adopt to gay couples as his office had been doing for years, as legally required, for opposite-sex couples.

The court declined to hear an appeal by a group of San Diego gun owners who claimed the law violated their constitutional Second Amendment right to bear arms. Even when a business owner's religious beliefs may motivate her to discriminate, that doesn't justify an exemption from our civil rights laws.

"They said you have to create cakes for same-sex couples, so he removed himself from the market", Jeremy Tedesco, a lawyer with Alliance Defending Freedom, told the L.A. Times.

"It would affect the same types of cases we had with the flower shop and the one OR bakery involved with this", Ross said.

The state tried again with a law in 2014, and the leagues sued again.

Justice Clarence Thomas, with Neil Gorsuch, had urged the court to take up the challenge.

New Jersey wants to legalize gambling on sports - and will make its case before the Supreme Court.

The court made its decision without requiring oral argument or additional briefing on the case.
