Sinclair's ruling compels Bream's appearance - and possible testimony - in the ongoing preliminary hearing of 18 Penn State students charged with contributing to the February 2 hazing-related death of Timothy Piazza.

Piazza later died from his injuries and an investigation revealed it was almost 12 hours before anyone called 9-1-1. "Until then, this case is not about Mr. Bream". Ambrose said, before DA Parks Miller objected to the question, saying that Bream's role was not relevant as he was not charged in the case.

Some defendants are accused of involuntary manslaughter and aggravated assault, while others are accused of hazing violations and evidence tampering.

Of the 18 individuals charged, two waived their right to appear at the preliminary hearings, which began in June and are continuing Thursday and Friday. Sinclair has to determine if there is sufficient evidence to send the case to county court for trial.

District Judge Allen Sinclair scheduled a contempt hearing for Bream for the end of the month.

Ambrose argued that Bream was aware of the subpoena and avoided it.

However, defense attorneys continued to exhibit disbelief that Bream, who lived on the second floor of the fraternity house, could have remained oblivious to the booze-fueled and boisterous events of the night.

Scicchitano testified that it was discovered by police about a week and a half ago that footage had been deleted.

The person suspected of deleting the footage hasn't been named.

But there was no video from the basement, where Piazza convened with others after the ceremony.

Parks Miller shot down that claim, stating that the investigation into the deleted footage is a new investigation and would result in new charges.
