The civil suit was brought by 11 people from the Northeast who collectively spent thousands of dollars on Poland Spring brand water in recent years. But should we be concerned about whether the label on that bottle is actually telling us the truth about the water inside? Rather than spring water, Nestle Waters is actually purifying and bottling groundwater, some of which comes from sites near waste and garbage dumps, the suit claims.
Turns out, consumers may have a have reason to be concerned.
While Poland Springs says its water bottles contain "100 percent natural spring water" from a source deep in Maine's woods, the complaint filed August 15 in federal court in CT claims that Nestle Waters North America has bottled well water that doesn't meet the U.S.
The class-action lawsuit filed Tuesday in federal court in CT claims that parent company Nestle Waters North America is bottling common groundwater that doesn't meet the federal definition of spring water.
The lawsuit claimed Poland Spring water sources in Hollis, Fryeburg, Denmark, Dallas Plantation, Pierce Pond Township and Kingfield may not be legitimate either. In 2003, the company settled a class action lawsuit alleging Poland Spring Water does not come from a spring. Tuesday claimed Poland Spring Bottled Water is "a colossal fraud". The complainants contend that Poland Spring water is "collected from wells it drilled in saturated plains or valleys where the water table is within a few feet of the earth's surface".
"I know that the water they're drawing from here in Poland, to the best of my knowledge, is truly spring water", he said.
In a statement, a Nestle Waters spokesperson said that its water meets all relevant federal and state regulations on the classification and collection of spring water and that the suit is "an obvious attempt to manipulate the legal system for personal gain".
Nestle in North America distributes or bottles 15 different water brands including Deer Park, Arrowhead, Montclair and Ice Mountain, shows a fact sheet for the company on its official website.
It also says that "The "spring" Defendant now claims exists in Poland Spring is at the bottom of a lake".
It alleges that the water in the bottled labeled as Poland Spring water is not collected from any pristine forest or mountain springs as images on the labels would imply.
"To consumers, "spring water" from a naturally occurring spring signifies purity and high quality and commands a premium price compared to Defendant's non-spring drinking water products or filtered tap water", the lawsuit continues.
This is not the first time Poland Spring faced legal action regarding its quality of water.
In a statement, Nestle Waters vowed to fight the suit.
Nestle is seeking state approval to source water from a public water district well in Lincoln. In that case, the company did not admit the allegation but reportedly agreed to pay about $10 million in discounts to consumers and charity contributions.
