Several lawmakers involved in discussions told the Times/Herald nursing home owners strongly objected to being ordered to pay for an alternative power source. The Sun-Sentinel reports that Michel "has history of fraud charges".

The case was settled in 2006 for $15.4 million.

The Florida Department of Health also rejected responsibility for the incident.

With all of Florida's major utility companies working overtime to restore power to millions of customers in the midst of one of the largest disaster blackouts in US history, the nursing home staff had to know that despite their requests, power wasn't likely to be restored immediately - especially given that hospitals and other critical infrastructure were higher on the priority list. Drinking water and power were cut off, all three of the islands' hospitals were closed, and gasoline was extremely limited.
