A federal appeals court cleared the way for the NFL to impose a six-game suspension on Dallas Cowboys star Ezekiel Elliott over domestic violence allegations on Thursday, siding with the league in the latest high-profile fight over its ability to punish players for off-field behavior.
Dallas Cowboys running back Ezekiel Elliott's future is in the hands of the 5th Circuit Court.
The six-game suspension was handed down in August after a 13-month investigation into an alleged string of domestic violence incidents in Columbus, Ohio the week of Elliott's 21st birthday.
"So the Players Association could ask the district court in NY or perhaps some other court to reinstate the preliminary injunction, which would put that suspension back on hold", Feldman said on NFL Network's TNF First Look.
The ruling clears the way for the National Football League to enforce the six-game domestic violence suspension they handed Elliott this offseason.
In his dissenting decision, judge James E. Graves wrote he believed the district court properly and concluded the "NFL is unable to show a likelihood of success on the merits of any irreparable injury for purposes of a stay". The 5th Circuit's decision says that Elliott and the NFLPA filed their lawsuit prematurely, going against the league's collective bargaining agreement. In its ruling, the 5th Circuit agreed with league attorneys who argued that Elliott prematurely sued the league September 1.
What does this mean for Elliott?
Elliott's lawyers point to appeals hearing testimony from Roberts that notes her lack of support for a suspension because she questioned Thompson's credibility. The league's headquarters is in Manhattan, not Texas, and other cases, including the fight between the league and New England Patriots quarterback Tom Brady, were heard in that court.
Milwaukee County and the State of CT , which did not receive letters in the initial review, were also found to be compliant. The cities of New York , Philadelphia and New Orleans are also out of compliance with federal law, according to the DOJ.
