  • Police force deployed at out side the Max hospital Shalimar Bagh

Meanwhile, the Delhi police on Wednesday transferred the case to its Crime Branch for a detailed probe, a senior official said.

The infant died due to an infection at a nursing home after battling for life for almost a week - which jolted the entire family, which was demanding the arrest of erring doctors. The parents on their way to the funeral of their baby noticed that the bag in which the baby was placed by the hospital was moving.

On November 30, Ashish Kumar's wife gave birth to premature twins (boy and girl) at Max hospital in Shalimar Bagh. But to their utter horror, the the boy was still alive, while they were on way to do their final rites.

Deputy Commissioner of police (northwest) Delhi, Aslam Khan, confirmed the news and told the Press Trust of India that the baby died on Tuesday evening. However, Dr Sanjeev Gupta of Aggarwal Hospital said that baby was of just 22 weeks and it was hard for him to survive from the start as he needed too much support. While we understand that survival in extreme preterm births is rare, it is always painful for the parents and family. "We wish them the strength to cope with their loss", the statement said.

Investigating a complaint filed by a patient's attendant, Vijay Sharma, the CCI report stated that the practice was prevalent in all 14 of the Max group and in corporate hospitals.

Their father told reporters that he would not take the child's body home unless the two doctors were arrested.

Dr. Sandeep Gupta, who was treating the baby at the Delhi New Born Center said "we knew from the beginning that he may not survive but we were trying our best". This was against the prescribed norms for dealing with newborns.

The hospital had sacked two doctors involved in the case but has said its internal investigation was not complete yet.

The family also continued its protest outside Max hospital on Wednesday demanding action against the authorities and the doctors. Mr. Jain had on December 2 said the licence of the hospital could be cancelled if found guilty of negligence.

In recent months this is a second incident that has made headlines where a private hospital in India has been called out for its negligence.
