The lawsuit was filed Monday in Miami-Dade Circuit Court on behalf of Marquise Rashaad Hepburn.

Morgan said his client was riding his bike to work when the bridge failed, causing a vehicle that veered to get out of the way of the collapse to hit Hepburn, throwing him from his bicycle.

Hepburn, "like many other unsuspecting victims, was simply performing ordinary activities and like many other victims of this horrific event was simply passing under the bridge without warning of increased danger", the lawsuit reads.

Gov. Rick Scott on Monday directed Florida's Department of Transportation to withhold payments of over $13.6 million in federal funding for the collapsed bridge, pending the completion of a National Transportation Safety Board investigation.

He was on spring break when the bridge fell, but he said the experiences of the victims trapped beneath the bridge had been weighing on his mind. The voicemail wasn't picked up until after the collapse, however.

"I was calling to share with you some information about the FIU pedestrian bridge and some cracking that's been observed", Denney Pate said in the voicemail.

The beginnings of a memorial to the six people who died in the collapse of a bridge at Florida International University appeared Sunday - a single bouquet of flowers and six small wooden crosses on cords hung from a wall and held in place by pieces of rubble.

"If there's a crack in the bridge why is the motoring public still able to travel under the bridge?"

"We will pursue answers to find out what factors led to this tragic situation, but it is important that the agencies responsible for investigating this devastating situation are given the appropriate time in order to accurately identify what factors led to the accident during construction".
