Judge Loya verdict: UP CM seeks Rahul's apology

"It was a conspiracy by the Congress and its chief Rahul Gandhi to finish the political career of BJP President Amit Shah, as part of which wrong accusations were made and an over 100-strong delegation was taken to the President", he said. Petitions were filed in the Supreme Court seeking an independent probe after judges in a lower court had dismissed the need for a probe.

Shah was one of those who were discharged in the Sohrabuddin case.

The Congress also dared the government to order an independent investigation and asked why it was shying away from it if judge Loya's death was natural. But Loya's son had on January 14 said in Mumbai that his father had died of natural causes. Minutes after the press conference ended, senior advocate Indira Jaising met Justice Chelameswar, who also confirmed to TOI that the allocation of the Loya case was indeed the proverbial last straw.

The top court of the country also said that frivolous and motivated petitions should be discouraged. "This court would be failing in its duty if it were not to stand by them", it said.

In the strongly-worded blog, Jaitley, who is also a renowned Supreme Court lawyer, called the judge Brijgopal Harkishan Loya death case an instance "that nearly created a judicial mutiny". While Dave had cast aspersions on two High Court judges and wanted to cross-examine four lower court ones, Bhushan had submitted that Justices Khanwilkar and Chandrachud should recuse from hearing the matter as they had been judges of the Bombay High Court and could have known the concerned judicial officers from there. "Political rivalries have to be resolved in the great hall of democracy when the electorate votes its representatives in and out of office". Loya case as millions of "Indians can see the truth", a day after the judge's family said "there is no hope left".

Mentioning that the Congress levelled baseless allegations against BJP President Amit Shah and misled the nation, he said, while responding to a query, that the matter has become an issue before Karnataka elections. Loya's death had snowballed into a major political issue and a rallying cry for the Congress-led Opposition.

Activist lawyer Prashant Bhushan dubbed the verdict as a "black day" for judiciary but noted jurist Soli Sorbajee said the dismissal of PILs have given warning to those who file such pleas without cogent materials only for publicity.

Congress Spokesperson Randeep Singh Surjewala posted the letter on his twitter account, saying the effort was to stop an enquiry into the case.
