Pres. Defeats Daniels' Defamation Case

Daniels also mocked Trump by saying that she must've gotten to the portion of her book where she made fun of his penis while describing what it was like to have sex with him.

A judge dismissed the defamation lawsuit from Stormy Daniels against President Donald Trump Monday and ordered her to pay his legal fees.

The dueling tweets came after District Judge S. James Otero dismissed Daniels's suit Monday claiming that Trump defamed her when he suggested she was lying about being threatened to keep quiet about their alleged relationship.

"The First Amendment (of the US Constitution) protects this type of rhetorical statement".

In an interview with CBS News earlier this year, Stormy Daniels said a stranger approached her while she was with her young daughter and threatened her.

But Avenatti, who is mulling a 2020 presidential run and is one of the president's most vocal critics, swiftly fired back at the latest tweet, blasting Trump as a "shyster" and a "liar".

Daniels said the man approached her as she was getting her infant daughter out of the auto to attend a mommy-and-me exercise class.

In dismissing the suit, the judge said Trump's tweet was a "hyperbolic statement" against a political adversary.

"Having granted the Special Motion [to dismiss] and denied Plaintiff leave to amend, the Court finally holds that Defendant is entitled to attorney's fees", Otero said.

"Daniels' other claims against Trump and Cohen proceed unaffected", tweeted Avenatti.

She claims Trump lied when responding to her allegations that he forcibly kissed and groped her in 2007.

He branded the ruling "limited" and said it will not affect her primary case against Trump and his former attorney Michael Cohen, which seeks to invalidate her 2016 nondisclosure agreement. "A total con job, playing the Fake News Media for Fools (but they know it)!"

President Trump sparked a Twitter tiff with lawyer Michael Avenatti on Tuesday after calling his client Stormy Daniels "Horseface" while celebrating the ruling on her defamation lawsuit.
