Unnao rape accused Kuldeep Singh Sengar expelled from BJP

Reports said the victim had earlier written a letter to the CJI stating that she faced threats from the accused, BJP legislator Kuldeep Singh Sengar.

The woman is battling for her life after a weekend vehicle crash in her northern home state of Uttar Pradesh that police are investigating after her family said they were being targeted.

The Supreme Court on Friday suspended its decision a day before to transfer outside Uttar Pradesh the CBI case into the car-truck collision that left the Unnao rape survivor and her lawyer critically injured and killed two of her relatives.

The Bench gave liberty to the family of the victim and the lawyer to approach the Supreme Court's secretary general at any point for moving them to AIIMS in Delhi.

The four-time lawmaker, Sengar is accused of raping the girl when she went to meet him along with a neighbour to seek his help in getting a job in June 2017.

After CBI taking over the probe in the Unnao rape and accident case, it was the turn of the Supreme Court on Thursday to order swift action. The apex court has also asked the CBI to complete the probe into the truck accident - where the survivor and her lawyer were injured and two of the survivor's aunts were killed - within a fortnight and preferably within seven days. We want justice to come to her. Sengar has nothing to do with the party as of now. The family had alleged that the accident was an attempt to eliminate her and the family.

"We will be failing in duty if we don't grant a compensation", the court said.

Kuldeep Sengar, the accused MLA, whom BJP expelled from the party on Thursday, has been in jail for the past several months.

"Whatever the government can do, it has done too late", Mr Dinesh Sharma deputy chief minister of Uttar Pradesh, where the BJP is in power, told Indian media.

Sengar is in jail awaiting trial and could not be reached for comment, but has previously denied the rape allegation.

A 19-year-old rape victim is fighting for her life in hospital after a key eyewitness, her father and aunts died in mysterious circumstances.

Sengar has already been charge-sheeted by CBI for rape and is now in jail after being arrested on April 13 previous year.

CJI also nominated Justice Deepak Gupta to hear all the cases pertaining to Unnao rape incident.

On Monday, Uttar Pradesh police filed a murder case against Sengar and nine others after the rape survivor's family filed a complaint alleging conspiracy behind the accident.

The case is the latest alleged sexual assault to cause outrage in India, where violent crime against women has been on the rise despite tough new laws.
